De Nederlandse Eerste Kamer heeft de wet Kansspelen op Afstand (KOA) goedgekeurd, die waarschijnlijk vanaf begin 2020 in werking treedt. De nieuwe wet Kansspelen op Afstand bevat een uitgebreid pakket aan maatregelen om kansspelverslaving te voorkomen. Aanbieders moeten spelers veel beter in de gaten houden. Naast het voorkomen van verslaving zorgt de nieuwe wet ervoor dat het speelveld voor online kansspelen veiliger en eerlijker wordt. Alleen betrouwbare aanbieders komen direct voor een vergunning in aanmerking.

Het Verenigd Koninkrijk heeft flinke boetes uitgedeeld aan aanbieders van kansspelen, omdat ze niet streng genoeg optreden om gokverslaving te voorkomen.

De nieuwe wetgeving is broodnodig, maar wordt beperkt door de Algemene Verordening Gegevensbescherming (AVG). Het is moeilijk om de juiste leveranciers te vinden die data-oplossingen aanbieden die in lijn zijn met de AVG en die gegevens verzamelen die nodig zijn om verantwoord gokken te ondersteunen.

Alle oplossingen hebben één ding gemeen: toegang tot identiteitsgegevens. De klant/speler en aanbieder moeten op dezelfde golflengte zitten wanneer het gaat over het verifiëren van identiteitsgegevens. Dit moet in wederzijds vertrouwen en op een transparante manier gebeuren.

Ook is er behoefte aan het delen van informatie om fraude en witwassen van geld tegen te gaan. CDDN biedt een gemeenschappelijk platform dat prima werkt voor de meer dan 1000 bedrijven die hun krachten verenigd hebben op dit platform. Aanbieders van kansspelen hebben nood aan een onafhankelijk platform waar ze informatie over fraude kunnen delen om zo het verantwoord gokken te ondersteunen. Op dat vlak is er echter nog een lange weg te gaan.

The Remote Gambling Act (RGA) has been approved by the Dutch First Chamber. As a result, it will become possible to apply for a licence in the Netherlands for the purpose of offering online gambling. It is currently still illegal to offer such games. The new legislation is currently expected to come into force at the end of 2020 or the beginning of 2021.

The Remote Gambling act, which is a modernisation of the Betting and Gaming Act, will make it possible to legally offer and play games of chance via the internet. The idea behind legalisation – in which many countries have preceded the Netherlands – is that issuing licences allows for the establishment of stringent conditions for online betting and gaming operators. These conditions, set out in a licence, are intended to protect players, combat gambling addiction and ensure the fairness of the game. Games of chance are a high-risk product.

In the UK, several online casino companies and their senior management have faced widespread action from the gambling regulator, as part of an ongoing investigation into the way the industry combats problem gambling and money laundering. Huge fines had to be paid by three companies as a result of their failings to put in place effective safeguards to prevent money laundering and keep consumers safe from gambling-related harm. 

It is thus clear that responsible gambling solutions are highly needed. They are, however, restricted due to GDPR regulation. It is still very difficult to find the right suppliers that offer GDPR-proof data solutions and the right data that support responsible gaming. 

All solutions have one thing in common: access to identity data. Customer and operator have to walk hand in hand when it comes to verifying a person’s credentials. Willingly and in a transparent way.

Moreover, there is the need to share information regarding anti-fraud and AML (Anti Money Laundering). CDDN services a community model that works brilliantly for the more than 1.000 companies who have joined forces in this community. Operators need an independent platform where they can share fraudulent information to support Responsible Gambling. There is, however, still a long way to go.
